Donovan Searles, LLC Announces That The Superior Court of New Jersey
Has Certified A Statewide Class Of Persons Who Purchased Or
Leased A Kia Sephia Automobile To Pursue Breach of Warranty and
Consumer Fraud Act Claims Arising Out Of the Allegedly Defective Braking System On The Sephia.
Philadelphia, PA September 15th, 2003 - The law firm of Donovan Searles, LLC,
announces that the Superior Court of New Jersey in Union County has certified
a statewide class of purchasers or lessees of the Kia Sephia automobile to
pursue breach of warranty and Consumer Fraud Act claims arising from the
allegedly defective braking system on the Sephia. The case is entitled
Regina Little v. Kia Motors America, Inc., No. UNN-L-800-01 (Law Division Aug. 20, 2003)
In a decision and order issued on August 20, 2003, the Honorable
Edward W. Beglin, Jr. of the Superior Court found that "[t]he operative
facts here start with and in large measure must remain focused upon the
allegation that throughout the period in question the braking system of
this particular model of that automobile carried a defect. More
particularly and specifically, that defect is said to exist as to the
brake pads and the rotors and the size of same so that the heat that
any braking system generates, because braking is a product of friction,
the heat that system produces is not dissipated in a manner that allows
the vehicle to continue to be operated safely." The Court further
found that Kia was aware "that it was producing a product that
carried a defect known to it. Its own technical service bulletins
underline this awareness."
