The Complaint alleges that, prior to 1988, defendants WilTel Communications and MCI WorldCom, Inc., pursuant to agreements with railroads, installed fiber optic cables and related hardware in the railroads' right of way easements on more than 1,000 miles of land in Pennsylvania belonging to class members, proceeding to do so without class members' permission, without utilizing legal process and without compensation.
In an Indiana case settled in May, AT&T agreed to pay landowners $45,000 per mile to settle claims of trespass and misuse of land based on similar allegations.
